ELEVATE CONFERENCE

Consent & Release

This consent and release is entered into between Greer Productions LLC, a Washington limited liability
company doing business as ELEVATE (hereinafter “ELEVATE”) and you, the ELEVATE conference
participant identified on the signature line below. You agree to the following terms associated with your
participation at the ELEVATE conference (the “Conference”):


THE CONFERENCE
The ELEVATE Conference is for owners looking to share, learn and level-up.  Often the most sage advice
and helpful ideas come from other owners.  The goal of ELEVATE is to provide space where owners can
explore new ideas and collaborate.  Over the 2 days you will hear the experience and expertise from owners
who face the same hurdles as you.  You will also have focused time to workshop a variety of ideas with
other owners.   


During the workshop time we will facilitate discussions around operations and explore ways to create
efficiencies, expand your agency and advance your vision.     

By the end of the Conference we hope you go away with a better understanding of areas of growth, a plan
for creating the agency you want and some new connections in this industry.

REGISTRATION FEES
The registration fees for the Conference are as follows, and all such fees are due at the time of registration:
Register by January 3, 2024 and the registration fee is $500 if you book a room through our room block.

Register by January 3, 2024 and the registration fee is $700 if you do not book a room through our room block.
 

Register by February 28, 2025 and the registration fee is $700 if you book a room through our room block.

Register by February 28, 2025 and the registration fee is $900 if you do not book a room through our room block.

 

CANCELLATION  REFUNDS
You may cancel your registration for the Conference by sending notice of cancellation in writing to
jolene@practicallymagic.co . Any refunds associated with cancellation are subject to the following terms:
Cancellations received in writing by January 7th, 2025 will qualify for a refund of 50% of the registration
fee.
Cancellations received in writing between January 8th and February 28, 2025 will qualify for a refund of
25% of the registration fee.


Cancellations after March 1, 2025 are not eligible for any refunds.

RISK ACKNOWLEDGEMENT & LIABILITY RELEASE
You acknowledge and agree that your participation at the Conference may expose you to certain risks

including but not limited to public hazards, venue hazards, damages caused by third-parties or other
participants, Covid-19, harm to you, harm to your guests or your property, or other damages, and you
assume any and all such risks, injuries, consequences, medical bills, expenses, death, or other damages
that may arise in connection with your participation at the Conference.


Further, to the maximum extent permitted by law you hereby release and hold harmless ELEVATE, its
board, its board members, administrators, directors, officers, teachers, employees, agents, assigns, and
volunteers (“Released Parties”) from and against any and all claims, demands, actions, complaints, suits or
other forms of liability (the “Damages”) arising out of or in connection with your participation at the
Conference. You also agree to indemnify and hold harmless the Released Parties from any Damages they
incur arising out of or relating to your participation in the Conference, including any and all related costs,
attorney fees, liabilities, settlements, and/or judgments. To the extent ELEVATE is found liable by an
arbitrator or court of competent jurisdiction for any Damages, in no event will ELEVATE’s damages to you or
any third parties exceed the registration fee paid by you to attend the Conference.

 

WARRANTY DISCLAIMER
ELEVATE will host the Conference at the designated venue during the specified dates. Otherwise,
ELEVATE makes no warranties or representations about any particular aspect of the Conference, including
any activities or events that may or may not occur during the Conference. All aspects of the Conference are
provided as-is.


LIKENESS RELEASE & INTELLECTUAL PROPERTY
You acknowledge and agree that ELEVATE and its agents may photograph, videotape, and otherwise
record your participation at the Conference) (all such recording are hereinafter referred to as the “Marketing
Content.”). ELEVATE shall be the sole owner of all such Marketing Content and may use the Marketing
Content for public marketing purposes, commercially, or otherwise. You hereby grant to ELEVATE the right
to use your likeness as it appears in the Marketing Content, and you hereby release the Released Parties
from any Damages associated with ELEVATE’s use of the Marketing Content, expressly including any
claims of libel, slander, or defamation. In addition, as between you and ELEVATE, ELEVATE is the sole and
exclusive owner of all intellectual property associated with the Conference, including all copyrights,
trademarks, trade secrets, and other proprietary aspects of the Conference, and you may not use, sell, or
recreate any such content aside from your personal uses in connection with your participation at the
Conference.

 

PROMOTION

During the duration of the conference, you acknowledge and agree that the promotion of your products or services or companies you are affiliated with is limited to designated areas, including the official tradeshow or sponsored presentations you have contractually signed up for. You shall refrain from promoting your products or services or affiliated businesses outside of these specified spaces.

 

Violation of this restriction may result in corrective measures, including but not limited to a verbal warning, removal from the conference premises, or other actions deemed appropriate by the organizers.

This provision is designed to maintain the integrity of the conference and create a focused and conducive environment for all participants. You understand and agree to comply with this restriction.


MISCELLANEOUS


This Agreement is governed by the laws of the state of Washington. Any matters arising out of or related to
this Agreement that cannot be resolved by private settlement, must be resolved by binding arbitration
pursuant to AAA rules, and the prevailing party shall be entitled to collect its costs and attorney fees. If any
term, provision, covenant or condition of this Agreement is held by an arbitrator or a court of competent
jurisdiction to be invalid, void or unenforceable, the rest of the Agreement shall remain in full force and effect
and shall in no way be affected, impaired or invalidated.
